Terms and Conditions Agreement — The Moving Guys (PTY) LTD ("the Company")
1. Definitions
1.1 "Client" refers to any individual or entity requesting moving services.
1.2 "Services" refers to all relocation, transportation, packing, and related services provided by the Company.
1.3 "Goods" refers to all items handled, transported, or stored by the Company.
2. Scope of Services
2.1 The Company agrees to provide moving services as requested by the Client.
2.2 Services may include packing, loading, transportation, unloading, and unpacking.
2.3 Any additional services must be agreed upon in writing and may incur extra charges.
3. Bookings and Confirmation
3.1 A booking is only confirmed upon receipt of a deposit or full payment as agreed.
3.2 The Company reserves the right to decline or cancel bookings at its discretion.
3.3 The Client must provide accurate details regarding the move (addresses, inventory, access conditions).
4. Payment Terms
4.1 A deposit of ___% is required to secure the booking.
4.2 The remaining balance must be paid in full before or upon completion of services.
4.3 Payments can be made via cash, EFT, or other agreed methods.
4.4 Late payments may incur penalties or interest.
5. Cancellation and Refunds
5.1 Cancellation by the Client must be made at least 48 hours before the scheduled move.
5.2 Deposits may be non-refundable unless otherwise agreed.
5.3 Last-minute cancellations may result in a cancellation fee.
6. Client Responsibilities
6.1 The Client must ensure:
- Proper packing of fragile items (unless packing service is included)
- Easy access to premises
- Legal parking arrangements for moving vehicles
6.2 The Client must declare all high-value or fragile items before the move.
7. Company Responsibilities
7.1 The Company will handle all Goods with reasonable care and professionalism.
7.2 The Company will provide suitable vehicles and personnel for the job.
7.3 The Company will make reasonable efforts to meet agreed schedules but is not liable for delays beyond its control.
8. Liability and Insurance
8.1 The Company is not liable for:
- Pre-existing damage
- Improperly packed items by the Client
- Loss or damage due to unforeseen circumstances (e.g., accidents, weather, theft)
8.2 Limited liability applies unless insurance is arranged.
8.3 The Client is encouraged to arrange insurance for valuable items.
9. Damages and Claims
9.1 Any claims for loss or damage must be reported within 24 hours after delivery.
9.2 Claims must be supported by evidence (photos, inventory list, etc.).
9.3 Compensation, if applicable, will be assessed fairly and reasonably.
10. Delays and Force Majeure
10.1 The Company is not responsible for delays caused by:
- Traffic conditions
- Weather
- Road closures
- Mechanical breakdowns
10.2 In such cases, the Company will communicate and reschedule where possible.
11. Prohibited Items
11.1 The Company will not transport:
- Illegal goods
- Hazardous materials
- Firearms or explosives
- Perishable or dangerous items
12. Termination
12.1 The Company may terminate services if the Client breaches these terms.
12.2 The Client remains liable for any costs incurred up to termination.
13. Governing Law
13.1 This agreement shall be governed by the laws of the Republic of South Africa.
14. Entire Agreement
14.1 This document constitutes the full agreement between the Client and the Company.
14.2 No verbal agreements shall be binding unless confirmed in writing.
15. Acceptance
By signing below, both parties agree to the terms and conditions stated above.
